Having now done more reading into it. It's not formally illegal to be a communist. What they can do is use the Emergency powers act to arbitrarily detain people (on grounds not related to identity) and then hit the courts with the notwithstanding clause if it gets struck down.

If one is in the US, a communist, and not on that list, they should really re-evaluate the impact of their praxis.

Canada's not going to do shit, they might offer refuge to American refugees but they wouldn't do anything. Mexico might, but they're in a much weaker position to do so and would need some kind of agreement with basically all of Latin America to do it because if not they're creating a multi-front war.
