Do you know house much a team of some of the highest paid IT forensics and lawyers cost? That's before stock and says damages the team will come up with.
They'll be buried with paperwork and costs for their own legal team and looking at wage garnishment as well as be unhireable for anyone doing their due diligence.
It won't be about the money. It'll be about pain for the leaker and discouragement for the next person dumb enough to do it.
I'd argue if they sued the guy they should lose lose sales. As such they would be hurting themselves to sue him. Hell I'll just outright say I'll never buy or play another rockstar game if they sue someone for it.
Edit*: To be honest though... I probably wasn't going to play it anyways, lol. I haven't even bothered to look at the leaks. If someone thought leaks would possibly ruin something for them, why would they look at them?
