They are stopping the governor from assigning someone. And leaving the announcement until after it becomes an open spot in the election.

A recent law in Kentucky makes it so theres a special election. The governor can't appoint an interim.

Assuming the governor doesn't challenge that law because the appointment of a replacement is part of the state constitution
