I get what you are saying, but a conspiracy is a pretty broad definition that definitely encompasses NDAA.

"Conspiracy is an agreement between two or more people to commit an illegal act, generally requiring intent and, in many jurisdictions, an overt act toward the goal. In the U.S., federal conspiracy (18 USC 371) to defraud or commit an offense has a 5-year statute of limitations, often starting from the last overt act."

Considering the enormous amounts of fraud that have been committed by misusing these funds along with the lack of oversight I think it would definitely be a criminal conspiracy at this point.

Who knows how much money has been missappropiated. We may never know because no one will do the work necessary to find out. What would you call an unauditable agency that is funded by tax payer money?

It is not however a conspiracy theory if that is what you are alluding to. Also, your original point of putting in Pentagon might make more sense than the framework for funding it.
