Judges are just appointed by the administration, and fired at will. They were bad before this administration. They have for decades deported US citizens, some under just laughably false circumstances. Like this dude that was naturalized from west africa, they had a regional expert assert he was from liberia or something that he had never been to, the kicker is they deported him, a man in his 30s, as a newborn, a kid of like 3 years old.

That was back during the obama years. They have streamlined the deportation process to remove a lot of due process. Which is odd because they still seem to be really bad at deporting people. I don't see how it's so difficult for them to give everyone a fair hearing.

judges aren't fired at will. they are removed via impeachment. different branch of government. you're thinking of US attorneys maybe?

while i don't doubt this happened, do you remember a name or a year? i can pull up the case files (they're public record) and dig into it but this is a little too general to find. i want to see what their arguments were.

Immigration judges aren't actual judges. No, they aren't impeached, the administration fired a bunch of them unilaterally for siding with the accused too often just last year, then brought in a bunch of like military dickheads to do the job.

They are not federal judges, they aren't even possessing of legal qualifications if I recall.

Harper's Magazine, de facto deportations, idk year, 10 back or more. Highlighted guy deported to the wrong country was deported out of like texas, each region has an "expert" that will certify the country of origin of someone if they don't know, and in this case it was this university guy, that said they gave him the papers and basically told him what they wanted and he did it.

They basically just then forge papers. That is basically what it is, they forge papers, idk if to give to the receiving country or what.

Edit: I just wanted to add, immigration judges are to federal judges like administrative warrants are to judicial warrants.

Honestly, if I were in his shoes, I'd sue the pants off DHS, then head back to Ireland anyway, because fuck this shit-hole country.

[–] village604@adultswim.fan 2 points 9 hours ago

You can only sue the government if they allow you to.

[–] sommerset@thelemmy.club 2 points 16 hours ago

Yeah but how we expect to change things by self deporting?

Besides he's not winning by sueing it will take years to settle

I wonder what happens if it turns out that, indeed, ICE falsified his signature on the forms he refused to sign. Wouldn't that be exactly the kind of obstruction of government proceedings they accused anti-ICE protesters to do?

I have no confidence we'd ever know.

Since they submitted it in federal Federal court to a judge, I expect a strongly worded letter, then no punishment. If you did this in Federal court, expect some jail time, fine and automatically losing the case.
