Court’s shadow docket, embodies all the reasons why America’s highest Court should act carefully and slowly. K.M.K. v. Washington Interscholastic Activities Association involves a highly contentious issue — the plaintiffs in the case effectively want the Supreme Court to bar transgender women from women’s sports teams at high schools and universities, even in states that support trans inclusion in sports.

It also involves an appalling sexual assault allegation. One of the plaintiffs in the case is a high school women’s team wrestler who is identified only by her initials because she is a minor. She claims that one of her wrestling opponents, who is transgender, “forcefully” penetrated the plaintiff’s vagina with her fingers during a match.

As a memo from the local prosecutor’s office points out, if these allegations are true then K.M.K. is the victim of a very serious crime — rape in the third degree. The prosecutor’s office, however, decided not to prosecute because it concluded that it could not prove that a sex crime was committed beyond a reasonable doubt. Among other things, prosecutors spoke to the referee who officiated the match, and he said that “nothing stood out to him during the match” and that “after watching the video of the match, he could not say that the suspect’s hand placement was ‘anything out of the ordinary.’”

how the fuck does this even make it to scRotus in the first place. the alleged 'incident' could have occurred regardless of who the opponent was.

[–] billwashere@lemmy.world 10 points 20 hours ago

Fuck all this noise. Put damn weight/size restrictions on sports like they do in boxing and I don’t give a shit what kind of downstairs mixup you’ve got going on (btw this is a reference to Ol’ Gregg not something derogatory about trans genitals).

Everyone. Line up your children for genitle inspection.

Remember this is for your protection and traditional family values.

Now, please tell me about your kids junk.

“Umm, well he’s a ten year old boy…” “Woah woah, slow down. Details…”

Trans people have a justification to exist, unlike the supreme court

SMALL Government is MANDATING that EVERY LITTLE GIRL has her VAGINA Inspected if she Wants to play a Sport!

-LITERALLY Republicans!

[–] TRAHR@quokk.au 34 points 1 day ago (1 children)

A little girl walks into a bathroom and screams. Sitting there, scowling inside the stall, is the man who might be your next representative.

“I’m your Republican congressman,” the man says. “Now that we’re in charge, I’m checking to make sure there’s no trans people in the wrong bathroom.”

She protests; he insists. “I won the last election, and this is my priority. Now, let’s make sure you’re really a girl.”

This is the premise of the latest ad by the Progress Action Fund (PAF), a left-wing PAC running ads to “disrupt the right-wing media bubble,” as its website says.

Sad yet a masterpiece of political advertising. Only thing missing was a classic glove snap.

[–] plateee@piefed.social 9 points 1 day ago

As if they'd use a glove.

How long after this is the "just shoot trans women in the head" case going to go to them? I'm so tired of this stupid culture war, and I know it's only going to continue to escalate. I just want to be left alone.

[–] Nouvellalia@lemmy.world 7 points 14 hours ago

Well, those cases are so cut and dry they don't have to be escalated all the way to the supreme court. Plenty of men admit in court to murdering trans women, but follow it with "because I found out she was trans", and get off completely.

Why can't a league figure it out themselves? They need the fucking government to decide?

[–] Mantzy81@aussie.zone 4 points 20 hours ago

They don't but remember that the GOP will always say they want small government whilst simultaneously trying to invade every part of your lives, especially if it's about sex and gender. They're really freaky about that. They don't like people to just be who they want to be. You must conform to the guidebook.

[–] 13igtyme@startrek.website 11 points 1 day ago

There are none in any professional sports last I checked and only like 15 or so across highschool varsity and college.

[–] artyom@piefed.social 3 points 1 day ago

Because they're government leagues. If the WNBA wants to let trans women play, that's their prerogative, the govt has no say. These are government-run, if not government-funded sports.

[–] Pratai@piefed.ca 9 points 1 day ago

Like it’s a decision. They know what they’re going to do. And they were paid well for it.

[–] radiofreebc@lemmy.world 14 points 1 day ago (3 children)

Aren't most professional sports leagues unisex? Women could play in professional sports, if they could make the team. Why do we need to legislate this? Why do we even care?

[–] stickyprimer@lemmy.world 1 points 13 hours ago

Because sexual dimorphism.

[–] ryathal@sh.itjust.works 1 points 13 hours ago

The mens league is generally open. The women's league is explicitly closed.

[–] Bristlecone@lemmy.world 13 points 1 day ago

Spoiler: they're gonna fuckin do it

[–] the_q@piefed.social 9 points 1 day ago

I'm sorry trans folks. Your entire existence is to just be a distraction instead of just being fucking people.

[–] QueenHawlSera@piefed.social 4 points 1 day ago

And they're going to use KMK's claim of being assaulted as their next propaganda tool....

[–] CharlesDarwin@lemmy.world 4 points 1 day ago (1 children)

INB4 we get some galaxy-brained bullshit about how this is the fault of the Democratic Party....

[–] Nouvellalia@lemmy.world 2 points 14 hours ago

It's definitely not their fault, but I could certainly ask why they didn't enshrine protections into law when they had the chance.

[–] finley@lemmy.zip 6 points 1 day ago (1 children)

These monsters live only because you allow it

[–] lIlIlIlIlIlIl@lemmy.world 3 points 1 day ago

You* are allowing it.

Be the change that you call for. Is your idea not good enough for you to take charge? Or are you more of the “armchair general” type?

[–] einlander@lemmy.world 3 points 1 day ago

States Rights!

[–] santa@sh.itjust.works 2 points 1 day ago

Wait hold up. If they possibly can’t be in sports, could they be on the highest court in the land? On the same judicial team?

Oh, that’s different?
