That's because women were not considered people and thus could not be punished by the law, only by their own families. Just because there was no law against something (when the law applied mostly or at times only to males) doesn't mean it was considered ok or consequence-free.
Okay. His position in the article is that same-sex intercourse between two women would be frowned upon but not illegal.
That's (probably) because he, like the men who wrote the Bible, does not believe female-born people should be considered humans subject to the law, opting instead for honor-violence.
