A couple of years ago they had an ad with a couple making a nazi salute, facing each others. They said they were making a roof for the kids. Maybe I would have a tiny more respect for fascists pigs if they just admit they are fascist pigs. But maybe not.

Holy shit, I'm amazed that didn't result in criminal charges. I guess Germany isn't as serious about that law as they claim.

I wouldn't say that, it seems more like that small amount of ambiguity saved their ass. Similarly Die Partei has/had an election poster saying "Nazis töten", meaning both "killing nazis", as well as "nazis kill", which also sufficed to avoid punishment

Just to add, sometimes the ambiguity is too less: The slogan "Hängt die Grünen!" ("Hang the Greens!") of the nazi party "der III. Weg" (The Third Way) was forbidden by court. The interpretation "Hang the green ones!" referring to the green colour of their posters was too far off.

In the trial concerning posters by the far-right splinter party Der III. Weg bearing the slogan “Hang the Greens”, the Munich Magistrates’ Court has sentenced a 42-year-old man to six months’ imprisonment. A 65-year-old man was fined.

To loose the passive election right (for five years) one needs to be sentenced to at least one year imprisonment.

Loosing the right for lifetime requires a ruling of the federal constitutional court.

This is really disappointing. Germany is one of the countries I've considered for escaping the US. Unfortunately it seems the whole world is sliding to the right.

My posittion has previously been made unclear. I support human life, the continuity of the universe and such. Subjugation is never correct, regardless the perceived reason. The vegetables in your garden deserve a, "thanks".

Sicherlich nicht. Er hat das geschrieben nach dem Wahlergebniss. Nur "Sieg". Weil sie die stärksten Wahlergebnisse hatten. Logisch war da sicherlich genau der Hintergedanke dass solch eine Kommentarspalte ensteht (wäre dumm wenn er das nicht vorhergesehen hätte) Aber er wird und kann sich super einfach damit rausreden. Sieg schreien ist nicht illegal und ist ja nur ein Aufruf des Gewinnens.

Ihn wahrscheinlich nicht, weil "Sieg!" allein nicht strafbar ist. Das "Heil!" haben ja seine Follower reflexartig ergänzt.

Ich bin leider nicht tief genug im Äußerungsstrafrecht um es mit Gewissheit zu sagen. Allerdings ist es erstens offenkundig oder zmd naheliegend dass er diese Reaktion gewollt hat. Damit könnte man bereits über Volksverhetzung sprechen. Durch das nicht löschen des Beitrags trotz der Reaktionen, könnte man ebenfalls von Volksverhetzung sprechen.
