He’s probably confusing that it’s still properly on the books that you can’t immigrate here as a communist.
overruled by scotus but also they did say that if you were "detached from the constitution" they could but simply being a communist was not enough

It won’t stop them trying, but this admin has had a terrible success rate in court despite being able to appoint judges. They’ll probably pull out this old defunct law, charge someone with it, and then the charges will get dropped when a judge says “Yeah this was ruled unconstitutional decades ago, dismissed”
