Okay so I'll just brainstorm here because this is where the comrades are. My plan at this point is thus:
The notice to fix or vacate gives me three days that begin after it was posted, minus judicial holidays (like today being taken for the 4th) and the weekend. So Monday - Wednesday.
I will provoke my landlord into taking me to court on this complaint by talking back to her as if I am not impressed with her authority. She is a power tripper and keeping my window open during those non-counted days will set her on that path in stone. Being disrespected will give her tunnel vision
I have obtained a security camera I have pointed at my window. I will record all violations to my peaceful enjoyment from her closing my window without my consent, BUT CRITICALLY FOR THIS PLAN, I will record my window being closed for those three days.
I will present this evidence in court as a backstop, but I will also seek a judgement that I am not required to keep my window closed because it's not on my goddamned rental agreement in the first place
Once that's settled, I will retaliate with a laundry list of tenant rights violations she has committed and outright federal crimes, like stealing goddamned mail
And I'll expect a 30 day notice to vacate once she loses as her final parting shot.
