That's the point. The CIA might "arrest" him and then be "forced" to let him go based on pressure. Tucker's got CIA connections. They are manufacturing a situation for him where he's the controlled opposition.
I don't think he's even that, it's all an act. It's theater, keyfabe. Tucker's family has CIA connections. He's a CIA mouthpiece historically. He's playing the part of the heel who face-turned. He's "controlled opposition" to the "deep state"
