It's always (well, since 1937 or 1970, depending on how you wanna look at it) been federally illegal. Several states are actively breaking federal law and allow for sales in various forms. They've basically been left alone, but at any point the federal government could kick in the door of every "legal" Cannabis shop.

I believe the thing they're doing now is closing a loophole around growing low-THC plants.
