Sure they will. Many prosecutors are so bombastically driven to succeed that they will prosecute a case they can win even if they know it is not justice because winning at all costs is the only thing that matters to some.
You don't get into a good law school and don't become a country prosecutor by being a typical person. They are very much driven to succeed and have lived their entire lives that way.

My iPhone is backed up in the cloud and it's a matter of minutes to restore it, though the data can take longer to appear. It's not a real big deal for me to lose my phone, cost aside.
Assuming a prosecutor takes this to court, they will have to provide evidence during the probable cause hearing. If it goes that far, it will get dismissed if there is no evidence. It's more likely that the prosecutor does nothing unless there is something they have unknown to you or you are not telling us something.
People who are into technology tend to know a little bit about a lot of things that still rises well beyond the level of the average person. You don't get onto Lemmy without having some tech ability unless someone helped you set it up.

There is a great deal of worry about two things: 1, real creative people are being displaced since many no longer feel they need their services. 2, AI is not creative and cannot generate real art. It is really used only by people who cannot make art and usually cannot tell the difference.
That your assessment is very wrong. You may not understand the average person here or who they are.

People on Lemmy exist at a very high technical level. This place is full of people with advanced degrees in STEM.
This has nothing to do with that specific image, and more to do with the fact that it is AI generated. The complaint is that you should have either done the art yourself or had someone do it for you rather than let AI do it.
This was my thought. Not saying that there is any justification, but the phrasing is very leading.
