Yes: they are a victim and the police were at fault.
No: The perpetrator was clearly a violent criminal. The use of force is justified.
The police would only be at fault if it was a white person and the police officer is Hispanic or black. If they were white, it was an unfortunate tragedy and no-one at fault.
