Yeah, they would argue that here, and also against any regulation. Regulation by definition is a "barrier to development", that's its purpose. It's needed and wanted guide rails against rampant abuse of those who can't defend themselves otherwise, including birds.

We should not give those who would rape our world for their personal profit free rein to do so.

This feels like maybe the rules should have been rolled out slower, rather than all at once -- so that the proverbial frog (construction industry) didn't jump out of the pot.
