You could make the same argument about the glasses, I guess
I think the glasses are different because they are not as easily spotted as other video recording devices. Especially when someone disables the recording indicator (that is not very visible in the first place). They can be mistaken for normales glasses more easily.
An audio recording device can record without being seen by the other party.
That's not true at all, we've had cheap tiny hidden bodyworn recording devices for a long time.
