Then it's copyright infringement or anti-circumvention. It's all just bundled up in the tent of piracy to preserve rent extraction.

Also isn't it part of the user license that you're only allowed to play if you agree to the EULA?

For a EULA to be "valid", and oh boy am I using valid very loosely, it needs to be agreed before purchase and stipulates that its valid if you purchase the "product". As I did not purchase it, how is the EULA valid to me?
