I can't source it for you but I believe the requirement is that the work's primary purpose is for titillation. So for example there can scenes that pretty significantly cross the line into sexual territory but if that scene is part of a wider story that does not serve that as the primary purpose then it doesn't constitute porn. There are real sex scenes in movies with actors that do real sex acts but they're not considered porn.
