Well, the guy was on a mobility scooter, not pedestrian. And armed with a gun. Chasing isn't a joke. It took a month, but the job is done!

Important to note that you'll survive trauma because you're in the care of the hospital. It's later, when you need specific medication, that you die due to not being able to afford it.

Tbf, at 79 with mobility issues, if you're an able bodied adult male let's say 18-35ish and you actually started and escalated the altercation, and local laws regarding attempt to retreat (or lack thereof) are followed, he might could actually win the court case for self defense due to the totality of circumstances if his lawyer can convince the jury that he didn't start/escalate and he prevented death or great bodily injury to himself. Just a fun fact, you don't necessarily need to be armed.

I'm not saying what OOP did was legal, I'm saying "you r pussy because you no fight likely younger stronger man" doesn't consider the totality of the circumstances the way the law does, and therefore isn't really that strong of a point itself. Especially over other points like "he escalated/started it" and whatnot that y'know are more to the point.

Feel free to continue whiteknighting their point, but at least get mine correct please.

You've inserted yourself in a thread defending one particular side (in this case, your adopted position is "No but you seem to be if you have to pull out a gun instead of fighting me with your bare hands.")

The argument against is "actually being 79 and crippled, the court may consider that in a self defense case and as long as the septuagenarian in a chair follows all the other laws involved with self defense (not that he did in this case), that ain't the dunk you think it is."

Now that you're caught up, why should almost 80yr old people in electric scooters fist fight younger stronger more able bodied and unknown sill level guys instead of taking their age and situation into account? What benefit do they get? "Sure he got beat to death because his loose ass old guy skin rips open if he steps wrong but at least nobody called him a pussy?" Great lol, sure convinced me, but the court still actually cares about the totality of circumstances, so, congrats I guess.

That's a walk away and tackle later kind of problem. If their only move is "gun" then they have no other ability to protect themself. Walk away slowly, wait for them to let their guard down before tackling them in the scooter and taking their gun away. Let them cry that they can't abuse anyone anymore. Point it at them to show them what it feels like to stare down the barrel of someone angry at you, uncertain of what the next few seconds bring.
