Wow. That's an unpopular fact.

Recording Law says:

Courts have generally held that defamation exists to protect a living person's current standing in the community, not the memory of someone who has already died, so once the person dies there is no living plaintiff who can suffer the reputational injury the tort is designed to remedy.
